1. Acceptance of Terms
By downloading, installing, or using míto ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and Medina Apps LLC ("we," "us," or "our"). Your continued use of the App following any updates to these Terms constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to use míto. Some characters, including ones created by other users, have romantic or flirtatious personalities, and the App is rated for adults on the App Store. By using the App, you represent and warrant that you are 18 or older.
We do not knowingly allow anyone under 18 to use míto, and we do not knowingly collect personal data from children under 13. If we learn that a user is under 18, we will terminate their account and delete associated data promptly.
3. Description of Service
míto is an AI-powered voice companion application that allows users to have real-time spoken conversations with fictional characters. Key features include:
- Real-time voice conversations with AI characters powered by Google's Gemini API
- Character creation tools
- Relationship progression and memory systems, including stored text transcripts of your conversations and AI-generated summaries that let characters remember past calls (see the Privacy Policy for what is stored and how to delete it)
- Subscription and credit-based access tiers
Conversations are processed by third-party AI infrastructure. The characters in míto are entirely fictional. Any resemblance to real persons, living or dead, is coincidental. Responses generated by AI characters do not represent the views of Medina Apps LLC.
4. User Accounts
Sign-In
Creating an account requires signing in with Apple or Google. We never ask for or store a password. By signing in, you agree to the terms of the respective provider (Google or Apple).
Your account is what links your characters, credits, conversation history and character memories across sessions and devices.
Account Responsibility
You are responsible for all activity under your account. Do not share your account credentials. Notify us at info@valethero.org immediately if you suspect unauthorized access.
5. Subscriptions and Billing
Subscription Plans
míto offers auto-renewing subscription plans ("Pro") that unlock unlimited call time. Current pricing is displayed in the App and may change with notice.
Free Trial and Credits
Calls use credits. New accounts start with no credits; credits come with a míto Pro subscription and from other offers in the App. Credit amounts and any trial terms are displayed in the App and may be updated at any time.
Billing
Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
Cancellation
You may cancel your subscription at any time through your Apple ID account settings or at Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods.
Price Changes
We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes. Continued use after a price change takes effect constitutes acceptance of the new price.
Consumable Credits
Credits purchased as in-app purchases are non-refundable and non-transferable. Credits have no cash value and cannot be exchanged for money.
Refunds
All purchases are final and processed by Apple. Refund requests must be submitted to Apple directly through Apple's standard refund process.
Friend Invites
You may share your invite code with people you know. A new user who enters your code receives bonus credits, and you receive bonus credits after they complete a first call longer than one minute, in the amounts shown in the App. We limit how many invites can earn credits each month and allow each device to redeem one invite. Bonus credits have no cash value, cannot be transferred, and may be expired or changed. We may withhold or remove credits, or end the program, if we find fraud or abuse, including fake or duplicate accounts. Do not spam people with your code.
6. AI-Generated Content
Nature of AI
míto uses large language models and voice synthesis to generate character responses. AI-generated content:
- May be inaccurate, incomplete, or inappropriate
- Does not constitute professional advice of any kind (medical, legal, financial, psychological, or otherwise)
- Is not a substitute for human relationships or professional support
- May occasionally produce unexpected or inconsistent outputs
No Reliance
You agree not to rely on AI-generated content for any important decision. Medina Apps LLC is not responsible for any action taken based on AI responses in the App.
Emotional Wellbeing
míto is intended for entertainment. If you are experiencing a mental health crisis or need emotional support, please contact a qualified professional or a crisis line in your country.
7. User Conduct
You agree not to use míto to:
- Violate any applicable law or regulation
- Harass, abuse, or harm any person
- Attempt to manipulate AI characters into generating illegal, harmful, or explicitly sexual content involving minors
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use automated scripts or bots to access the App
- Circumvent any access controls, usage limits, or subscription paywalls
- Impersonate Medina Apps LLC or any other person or entity
- Interfere with the App's servers, networks, or infrastructure
We reserve the right to terminate any account we determine, in our sole discretion, to be in violation of these Terms.
8. Intellectual Property
Our Property
All content within míto — including but not limited to character designs, artwork, audio, software, and trade names — is owned by or licensed to Medina Apps LLC and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.
User-Created Characters
When you create a character using míto's creation tools, you retain ownership of the creative elements you provide (name, backstory, description). By submitting a character as public, you grant Medina Apps LLC a worldwide, royalty-free, non-exclusive license to display, distribute, and promote that character within the App.
9. Privacy
Your use of míto is governed by our Privacy Policy, incorporated here by reference. By using the App, you consent to the data practices described in the Privacy Policy.
10. Third-Party Services
míto integrates third-party services including:
- Google Firebase (authentication, database, analytics, crash reporting)
- Google Gemini API (AI voice and language processing)
- RevenueCat (subscription management)
- Apple App Store (billing)
Your use of these services is subject to their respective terms and privacy policies. Medina Apps LLC is not responsible for the practices of third-party providers.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MEDINA APPS LLC DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- AI responses will be accurate, appropriate, or complete
- The App will meet your specific requirements
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDINA APPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability to you for any claims arising from these Terms or the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $10 USD, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Medina Apps LLC and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.
14. Termination
We may suspend or terminate your access to míto at any time, with or without cause or notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and dispute resolution sections.
You may delete your account at any time within the App under Profile > Settings > Delete Account.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive any right to participate in class-action lawsuits or class-wide arbitration.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date above and, where appropriate, through an in-app notice. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
